What changed for nearshoring and offshoring in 2026?

Four 2026 developments change the math, and most guides on this topic predate them. Trade policy mostly affects goods, while services face one pending bill.

Tariffs and the USMCA review

On February 20, 2026, the Supreme Court ruled in Learning Resources v. Trump that IEEPA does not authorize tariffs, which ended the emergency tariffs on imports from Mexico, Canada, and China.

On July 1, 2026, the United States declined to renew USMCA in its current form. The agreement stays in force, but now faces annual reviews until 2036, which adds planning risk for manufacturing nearshoring. Tariffs apply to goods, not services work.

The proposed HIRE Act

The HIRE Act (S. 2976) would place a 25% excise tax on payments to foreign persons for services that benefit US consumers. It was referred to the Senate Finance Committee on October 6, 2025, and has not passed.

If it ever did, it would hit Mexico and the Philippines alike, because both are foreign. Proximity offers no shelter, so favor contracts you can exit rather than pausing plans.

Mexico's shorter workweek

Mexico's reform, published on May 1, 2026, cuts the maximum workweek from 48 to 46 hours on January 1, 2027, then by two hours a year to 40 by 2030. Pay cannot be cut, and electronic time records become mandatory.

For nearshore budgets, that means fewer hours for the same salary, a real rise in hourly cost over four years.

Research costs and AI

Under Public Law 119-21, US companies can again expense domestic research costs under Section 174A, but foreign research still amortizes over 15 years. That applies to nearshore and offshore software work alike.
