What is IRS Form 1096?

IRS Form 1096, the Annual Summary and Transmittal of U.S. Information Returns, is a one-page cover sheet you mail on top of paper information returns. It tells the IRS how many forms are enclosed, the total dollars reported, and the federal income tax withheld. It is used only for paper filing and never goes to the payee.

From our experience running contractor payments at scale, think of it as a packing slip that reports no new income. Every Form 1096 carries:

  • Filer details: name, address, contact person, phone, and email, matching your returns exactly
  • Taxpayer ID: your EIN in Box 1, or your SSN in Box 2
  • Totals: number of forms, federal tax withheld, and total amount reported
  • Form type: a single "X" in Box 6 for the one return type enclosed

Get those four right and the IRS can match the batch to you. Settle the contractor vs employee test first, since it decides which form you file.

What is the difference between Form 1099 and Form 1096?

Form 1099 reports income paid to one person. Form 1096 summarizes a batch of paper 1099s or similar returns for the IRS. A 1099 goes to both the IRS and the payee, while a 1096 goes only to the IRS, and only when you file on paper.

They share an envelope but do different jobs. Here is how they compare:

In short, the 1099 carries the data and the 1096 carries the 1099s. The other pair people often mix up is the W-9 and W-2, and the W-9 is where your 1099 data starts.

Who needs to file Form 1096?

Any business that mails paper Forms 1097, 1098, 1099, 3921, 3922, 5498, or W-2G to the IRS must file Form 1096 with them. E-filers never need it. The bigger 2026 question is whether a 1099 is triggered at all.

How did the $2,000 threshold change who files?

Section 70433 of the One Big Beautiful Bill Act raised the 1099-NEC and 1099-MISC threshold from $600 to $2,000 for payments made after December 31, 2025. It is indexed to inflation from 2027, and the backup withholding threshold moved with it.

What counts is when you paid, not when you file. Returns sent in early 2027 for 2026 payments use $2,000, so paying someone $1,500 across 2026 creates no 1099 and no 1096. If you are eager to see how payment method affects those records, refer to this guide on paying 1099 contractors.

Which returns does Form 1096 transmit?

The 2026 revision lists 38 return types in Box 6. These are the ones most businesses meet:

  • 1099-NEC: contractor pay of $2,000 or more for 2026 payments
  • 1099-MISC: rent, prizes, and other income, also at $2,000
  • 1099-INT and 1099-DIV: interest and dividends you pay out
  • 1098 series: mortgage and student loan interest, tuition
  • 3921, 3922, and 5498: stock option transfers and IRA contributions
  • W-2G: certain gambling winnings

Newer boxes include 1099-DA for digital asset sales, added in 2025, plus 1099-LPS and 5498-TA for 2026. Each type needs its own cover sheet.

When do you not need Form 1096?

You skip it entirely in three situations:

  • You e-file: the IRS system builds the summary for you
  • You file 10 or more returns: e-filing is then mandatory, so paper is off the table
  • You are paying wages: employees, including statutory employees, get a W-2, which travels with Form W-3 instead

Payments to foreign contractors working outside the US also generally fall outside the 1099 rules once you hold a valid W-8BEN form.

So the test is simple: a paper return from the Box 6 list, below the e-file line, needs a Form 1096 on top. For the worker's side, see this guide on taxes for independent contractors.

Can you file Form 1096 electronically?

No. Form 1096 exists only for paper filing. When you e-file information returns, the IRS system creates the summary automatically, so there is no 1096 to submit. E-filing is mandatory once you file 10 or more information returns in a calendar year, counted across all form types.

That aggregate count is where filers slip: five 1099-NECs plus five W-2s make ten, so both must be e-filed. Our guide to W-2 filing requirements covers the employee half of that count.

What changes when FIRE shuts down in 2026?

The IRS is retiring its FIRE e-filing system and moving every information return to IRIS, the Information Returns Intake System. These dates matter for the 2027 season:

  • November 1, 2026: last day for FIRE test files
  • November 9, 2026: last day to change a FIRE Transmitter Control Code application
  • November 19, 2026, 3 p.m. ET: final FIRE submission deadline
  • January 1, 2027: IRIS becomes the only system for current-year, prior-year, and corrected returns

Your FIRE Transmitter Control Code does not carry over, so apply for an IRIS code early. IRIS also offers a free portal for small filers.

The bottom line: paper plus a Form 1096 only makes sense while you stay under ten returns for the year.

How do you fill out Form 1096?

Fill in Form 1096 last, because three of its boxes are totals of the forms underneath.

Work through the steps below in order, and prepare one form for each return type you mail.

Step 1: What filer details go at the top?

Enter your business name and address, then the contact person's name, phone, email, and fax, exactly as on your 1099s. Never use a payroll service's or paying agent's name or TIN.

Step 2: Do you use Box 1 or Box 2?

Enter your EIN in Box 1, or your SSN in Box 2 only if you have no EIN. Use one, never both. The name and TIN must match your 94X-series returns, such as Form 941, or penalties can apply.

Step 3: What goes in Box 3?

Enter the number of correctly completed forms, not pages. Leave out blank or voided forms and the 1096 itself. One three-to-a-page sheet holding two completed forms counts as "2".

Step 4: What goes in Box 4?

Enter the total federal income tax withheld across the enclosed forms. Most contractor payments have none, so enter "0" unless you applied backup withholding. If withholding is new territory, our explainer on payroll deductions is a good starting point.

Step 5: What goes in Box 5?

Enter the total of specific boxes from the enclosed forms. For 1099-NEC, add Boxes 1 and 3. For 1099-MISC, add Boxes 1, 2, 3, 5, 6, 8, 9, 10, and 11. Leave Box 5 blank for Forms 1098-T, 1099-A, and 1099-G.

Step 6: How do you complete Box 6?

Mark one "X" for the single form type enclosed. Two types means two separate 1096s. The current form has no Box 7, so ignore older guides that tell you to check one.

Step 7: Who signs Form 1096?

Sign, add your title, and date the form. A paying agent can sign with authorization, but your business stays liable for accuracy and timing.

Boxes 4 and 5 are only as reliable as the payroll calculations and payment records behind them.

What does a completed Form 1096 look like?

Here is a worked example. A design studio paid four contractors in 2026: $2,500, $4,000, $1,800, and $3,000. The fourth never returned a W-9, so the studio applied 24% backup withholding, or $720.

The $1,800 payee is under the $2,000 threshold, so only three 1099-NECs are needed. The cover sheet then reads:

With three returns, the studio may still mail paper. Issuing a contractor pay stub with each payment makes those year-end totals easy to reconcile.

Where can you get Form 1096?

Order the official red-ink form from the IRS or buy it from an approved supplier. You cannot print the PDF from IRS.gov and mail it, because a printout is not machine-scannable and can draw a penalty.

The IRS says so directly on the Form 1096 PDF:

"Do not print and file a Form 1096 downloaded from this website; a penalty may be imposed for filing with the IRS information return forms that can't be scanned."

That rules out the "fillable" and "printable" Form 1096 files that show up in search. Use them to study the layout, then file on an official copy from one of these sources:

  1. The IRS online order page for information returns, which ships forms free
  2. The IRS forms line at 1-800-829-3676
  3. Office supply stores, or providers of payroll services for contractors

Order before January, and never reuse last year's blank.

When is Form 1096 due?

Form 1096 is due on the same day as the returns it transmits. For 2026 payments, that is February 1, 2027 with 1099-NEC, March 1, 2027 with most other 1099s, and June 1, 2027 with Forms 5498. Weekend and holiday dates roll to the next business day.

One trap catches paper filers every year. E-filers of the non-NEC forms get until March 31, 2027, but mailed returns get no extra time, so choosing paper costs you about a month.

What are the penalties for late or incorrect Form 1096 filing?

Form 1096 carries no separate penalty. Under IRC Section 6721, each return it transmits is penalized, rising with how late you fix it. Missing totals, unscannable forms, and wrong TINs all count.

The amounts below come from Revenue Procedure 2025-32, which set the figures for returns due in 2027.

Annual caps apply except for intentional disregard. For 2027 filings, a business averaging $5 million or less in gross receipts caps at $1,397,000, while larger filers cap at $4,191,500.

The quieter risk: Section 6722 applies the same schedule to late payee copies, so ten 1099s filed after August 1 can cost $3,400 twice.

Skipping Form 1096 leaves a paper batch incomplete, which the IRS can treat as not filed. When deadlines keep slipping, it may be more cost-effective to outsource compliance than to absorb the fines.

Where do you mail Form 1096?

Mail Form 1096 and its returns to one of three IRS centers, chosen by the state of your principal business, office, or legal residence. Filers based outside the US use the Austin address.

Send the original red-ink page flat, not folded or stapled, because photocopies are not accepted. These are the addresses printed on the 2026 form:

Use certified mail or an IRS-approved private delivery service so you can prove the filing date, and check the IRS where to file Form 1096 page before sealing the envelope.

How do you correct errors on Form 1096?

You correct the underlying return, then send a new Form 1096 with it. A 1096 has no "CORRECTED" box, so the cover sheet itself is never amended.

How do you fix a wrong amount, code, or checkbox?

This is a one-step correction:

  1. Prepare the return again with the "CORRECTED" box checked and the right figures
  2. Send it with a new Form 1096 covering only the corrected returns

Originals and corrections of the same form type can share one Form 1096.

How do you fix a wrong payee name or TIN?

Name and TIN errors take two returns instead of one:

  1. File the original return again with "CORRECTED" checked and every amount set to zero
  2. File a fresh return with the right details, leaving "CORRECTED" unchecked
  3. Send both with a new Form 1096 marked "Filed To Correct TIN" or "Filed To Correct Name" in the bottom margin

Either way, speed matters. A correction within 30 days drops the penalty to $60 per return, and you should keep copies for at least three years, or four for Form 1099-C.

Can you get an extension for Form 1096?

Yes, by filing Form 8809 before the original due date. For most information returns, one 30-day extension is automatic. For 1099-NEC it is not: the IRS grants it only for set reasons, such as a disaster, serious illness of the person responsible, or a first year in business.

It does not extend the date for furnishing recipient copies, so request it as soon as you know you will be late.

What mistakes should you avoid when filing Form 1096?

Most rejected batches fail on mixed form types or totals that do not match. A contractor onboarding checklist that collects a W-9 up front prevents most TIN errors too.

Run this check before sealing the envelope:

  • One Form 1096 per form type
  • Boxes 3, 4, and 5 reconcile to the enclosed forms
  • Filer name and TIN match your 94X returns
  • Official red-ink form for the right year, unstapled
